Ownership Notice: TackleBot is owned and operated by AestheticSpartan. See Section 2 for full details.

1. Introduction

By adding or interacting with the TackleBot Discord Bot ("the Bot", "TackleBot", "we", "us", "our"), operated by AestheticSpartan, in a Discord server or via direct message, you agree to comply with these Terms of Service ("Terms") and our Privacy Policy. These Terms govern your access to and use of the Bot, including all features, commands, updates, and related services.

2. Ownership & Maintenance

TackleBot is owned and maintained by AestheticSpartan. The TackleBot name, branding, original artwork, collectible egg designs, pet designs, and related original assets are the property of AestheticSpartan. Ownership and support inquiries are routed to AestheticSpartan via the official support server.

TackleBot also makes use of third-party assets that are not owned by AestheticSpartan. These include assets licensed or purchased through marketplaces and resource sites such as itch.io and the Unity Asset Store, as well as content created or contributed by members of the community. All such assets remain the property of their respective creators and are used under their applicable licenses. No ownership of third-party assets is claimed.

3. Third-Party Services

The Bot integrates with the following third-party services and APIs. Your use of related features is also subject to the terms and policies of these third parties:

• Discord API: Essential for all Bot operations within the Discord platform. Governed by Discord's Terms of Service and Privacy Policy.
• Top.gg API & Webhooks: Used to track votes, manage streaks, and distribute rewards.
• Supabase (PostgreSQL hosting): Used to store persistent bot data.
• Patreon & Ko-fi: Used to process voluntary contributions and supply supporter role information.

4. Compliance Requirements

4.1 Discord Terms of Service & Community Guidelines

You must adhere to Discord's Terms of Service and Community Guidelines at all times while interacting with the Bot. This includes, but is not limited to, prohibitions against harassment, hate speech, spam, and the distribution of harmful or illegal content.

4.2 Third-Party Service Terms

When using features that rely on the third-party services listed in Section 3, you must also comply with their respective terms and policies (e.g. Top.gg, Patreon, Ko-fi).

5. User Conduct

When using TackleBot, you agree not to:

• Engage in harassment, abuse, threats, or harmful behavior towards other users or the developer.
• Distribute spam, unauthorized advertising, illegal materials, or content that infringes intellectual property.
• Attempt to gain unauthorized access to the Bot's systems, data, or source code.
• Interfere with, disrupt, or impair the Bot's operation, stability, or security.
• Exploit, automate (botting), macro, or otherwise manipulate the collecting, economy, gambling, market, pet, farming, achievement, or leaderboard systems.
• Abuse bugs, duplication glitches, or unintended behavior instead of reporting them.
• Use multiple accounts to gain an unfair advantage in any game system, including votes and supporter rewards.

Violation of these conduct rules may result in temporary or permanent restrictions from using the Bot, data wipes, reporting to Discord, or other actions deemed necessary by the developer or server administrators.

6. Data Usage and Privacy

The Bot collects and processes data necessary to function and provide its features. This includes User IDs, Server IDs, and game progress (collection, economy, pets, farming, skills, achievements, voting, supporter status).

Your privacy is important to us. By using the Bot, you consent to the data practices described in our Privacy Policy. Please review it carefully for detailed information on what data we collect, how it's used, how long it's stored, your rights, and our use of third-party services.

7. Feature-Specific Terms

7.1 Collecting & Economy

The collecting game (/collect and related commands) involves claiming spawned items, managing an inventory, earning and banking Gold, and trading on the marketplace. All progress is tied to your Discord User ID.

7.2 Gambling Features

Gambling commands (e.g. /blackjack, /roulette, /highlow, /kiosk) use virtual in-game currency only. They involve no real-world money and have no monetary value. They are provided for entertainment within the game economy.

7.3 Voting (/vote) & Top.gg Integration

Voting for the Bot on Top.gg is optional but appreciated. Voting rewards (e.g. Voter Chests) are granted based on successful vote validation via the Top.gg webhook. You may receive DM reminders to vote; these can be disabled via /settings or provided buttons.

8. Payments & Refunds

Voluntary support for the Bot may be offered through Patreon and Ko-fi. By contributing through either platform, you acknowledge and agree that:

• No refunds are issued by AestheticSpartan for any Patreon or Ko-fi contributions, pledges, tips, or one-time donations.
• Any refund request must be initiated through Patreon's or Ko-fi's own refund channels and is subject to those platforms' policies, eligibility rules, and timelines. AestheticSpartan cannot process, approve, or override refund decisions on behalf of those platforms.
• Contributions are entirely voluntary and do not grant any ownership stake, equity, or intellectual-property rights in the Bot or its assets.
• Supporter perks are virtual, may change over time, and do not entitle the contributor to guaranteed features, service levels, response times, or specific outcomes.

9. Disclaimer of Warranty

The Bot is provided "AS IS" and "AS AVAILABLE" without warranty of any kind, express or implied. This includes, but is not limited to, warranties of merchantability, fitness for a particular purpose, availability, security, accuracy, or non-infringement. The developer does not guarantee that the Bot will be error-free, uninterrupted, or meet your specific requirements.

10. Limitation of Liability

To the maximum extent permitted by law, in no event shall AestheticSpartan be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, resulting from:

• Your access to or use of, or inability to access or use, the Bot.
• Any conduct or content of any third party on the service.
• Unauthorized access, use, or alteration of your transmissions or content.
• Any errors, bugs, or inaccuracies in the Bot's operation, including loss of in-game progress or virtual items.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes, typically via in-bot announcements or by updating the "Last updated" date below. Your continued use of the Bot after such changes constitutes your acceptance of the revised Terms.

12. Termination

We may terminate or suspend your access to the Bot immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Server administrators may also remove the Bot from their server at any time.
